Italy :

“All citizens have the same social dignity and they are equal before law, without sex, race, language, religion discrimination and also, the political opinions, social and personal conditions.”
This is the 3rd article of the Italian Constitution, but a month ago the most uncostitutional law was approved in Italy, with the name “Lodo Alfano”.
This law provides for the penal immunity for four of the dignities of the State: the President of the Republic, the President of Senate , the President of Chamber of Deputies and the President of Cabinet council.
It consists in the interruption of their penal processes from their engagement until to the end of their appointment.
Today, the President of Cabinet council, Silvio Berlusconi, has penal processes in currency, so he is the only one who finds this situation on his pro.
The President of the Republic, Giorgio Napolitano puts his own signature for this legislative decree.
He has no responsibilities for acts carried out during his charge, but only for high treason or attack to the Constitution… maybe for this reason he subscribes this law, so in this way he’ll be fully irresponsible.
In fact Napolitano hasn’t any civil powers, but he represents a guarantee for the observance of the Constitutional principles and the unity of the State.
At the end of XIX century (when Constitution was born), he was a very noble person, while today he is a puppet in the hands of more powerful people.
Approving this law the President of the Republic doesn’t realize his duty to defend the Italian Constitution.
Moreover he represents the Italian unity, but he has to be care with the majority’s wishes and that politicians don’t squabble each others.Constitutional Injustice
He is a person with a prestigious nomination: he has to wear very elegant in the morning and to be always kind and polite… but really the only thing that he has to say is: “Ok, even if I wisely don’t approve yours decisions, I shall do my best for all you want.”
Sorry for these offensive words President, but I’m the first to feel so offended because I can’t believe to belong to this rough country.

How could such a subjective legislation be passed?

Napolitano has authorized this law for a previous sentence of the 2004 Constitutional Court. It defined “an appreciable interest to assure a peaceful development of the dignities of the State”. Today, there is only one opposition party that continues to declare this law as immoral.

Silvio Berlusconi will definitely welcome such an immunity clause in the law for the President of the Republic, the President of Senate, the President of Chamber of Deputies and the President of Cabinet council. After all many graft charges are against him. I think money has a part to play in this legislation because Berlusconi is one of the richest men in Italy.

Good article, Stefania. Although I wouldn’t be so hard on Napolitano. Yes, he could have refused to sign the law, but only temporarily.

I do think the Lodo ALfano is immoral. All of Berlusconi’s ad-personam laws are immoral, a scandal for our country.

I know, I have been very severe with Napolitano, but I’m hurry with this role and not with his person. The gouvernment is at the service of S.B. Can be it also for the President of Republic? I believe in the Italian Constitution and I couldn’t accept this violation, even if it has the President’s signature...
